Terms of Service

These Terms govern your use of Mimiq (the "Service"), a Discord bot and web dashboard that generates text-to-speech audio and lets users create cloned voices. By installing the bot, signing into the dashboard, or using any feature of the Service, you agree to these Terms. If you don't agree, don't use the Service.

Mimiq is operated by Nadia Danu Maxine Christiana Alton, a UK sole trader trading as Mimiq. You can contact us at support@mimiq.gg.

1. Eligibility

You must be old enough to use Discord in your jurisdiction and you must comply with Discord's Terms of Service.

2. Your account & servers

You're responsible for what happens through Discord servers you administer using Mimiq, and for what your members generate using the bot. Server admins should use Mimiq's permission and moderation tools to enforce rules appropriate to their community.

3. Voice cloning & consent

You may only submit voice samples for cloning if (a) the voice is yours, or (b) you have explicit permission from the person whose voice it is. By clicking the consent button before a clone is saved, you confirm that one of those conditions is true.

You may not clone the voice of a public figure, celebrity, fictional character with an associated voice actor, or any other identifiable person without their explicit consent. Doing so may violate publicity, defamation, privacy, or biometric-data laws in your jurisdiction. If you do, you indemnify us against any resulting claims (see Section 9).

4. Acceptable use

You agree not to use Mimiq to generate or distribute content that:

• impersonates a real person without their consent;
• defames, harasses, threatens, or stalks any individual;
• contains sexual content involving minors;
• incites violence, self-harm, or hatred against a protected group;
• violates intellectual-property or publicity rights;
• is used for fraud, deception, scams, or unauthorized access;
• violates Discord's Community Guidelines or Terms of Service.

We may suspend, restrict, or remove access to the Service, for an individual user, a server, or both, at our discretion if we believe these rules are being broken. Cloned voices and audit data may be removed at the same time.

5. Free and paid plans

Mimiq offers a Free plan and an optional Mimiq Pro subscription for individual Discord servers. One subscription covers everyone using Mimiq in that server. The price, currency, billing period, taxes and included features are shown before purchase.

You may subscribe through Discord or directly through mimiq.gg. Website purchases are processed through Stripe Managed Payments under the Sold through Onelink brand in the UK (called Link in some countries), with Stripe acting as the merchant of record for those transactions. A subscription renews monthly until cancelled. Website subscriptions can be managed in the buyer's Onelink account, and Discord subscriptions can be managed in Discord. Unless a refund or legal cancellation right applies, Pro access continues until the end of the period already paid for.

The features and usage allowances for each plan are shown on the server billing page. We may change plans, prices or allowances for future billing periods. We will give reasonable notice before a change affects an existing paid subscription.

Discord handles refund requests for subscriptions bought through Discord under Discord's refund policy. Stripe Managed Payments provides transaction support for subscriptions bought through mimiq.gg. For help with Mimiq, contact support@mimiq.gg. Nothing in these Terms limits any cancellation, refund or other consumer right given to you by law.

Servers marked Early Access keep the allowances shown on their billing page without payment. Early Access belongs to that Discord server and remains if Mimiq is removed and later added back. New Pro-only features still require Pro.

6. Service changes

We may add, change, or remove features at any time. We may impose reasonable rate limits, change usage quotas, or temporarily suspend the Service for maintenance.

7. Third-party services

Mimiq depends on Discord for delivery, on a third-party TTS provider for voice generation and cloning, and on a third-party LLM for optional AI moderation. We aren't responsible for outages, data loss, or policy changes by those providers.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the Service will be uninterrupted, timely, secure, or error-free.

9. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from (a) content you submit or generate through the Service, (b) your breach of these Terms, or (c) your violation of any third-party right (including a cloned voice's owner).

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event, or (b) USD 100. We are not liable for indirect, incidental, special, or consequential damages.

11. Termination

You may stop using the Service at any time by removing the bot from your servers and signing out. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (indemnity, disclaimers, liability limits) survive.

12. Changes to these terms

We may update these Terms from time to time. The "Effective" date at the top reflects the current version. Continuing to use the Service after changes means you accept the updated Terms.
